What is the purpose of Form 1065-B?
The purpose of Form 1065-B is to report certain income from sources within the United States and certain items of foreign income that are deemed to be reported on and reportable to the Foreign Income Tax Exemption/Extension Act. In addition, Form 1065-B is to be used by the applicant for the Foreign Earned Income Exclusion. How to Use Form 1065-B Use Form 1065-B form to report amounts reported on Form 1040 (Form 1040A) and Forms 1040NR (Form 1040NR) from sources within the United States, excepting foreign earned income from sources within the United States reported on Form 40NR. See the Instructions for Form 1065-B for additional details. To report foreign income reported on Forms 4115 (Individual Retirement Savings Plan), 4231 (Student Loan Interest and Deduction), 4234 (Student Loan Interest), 4234A (Student Loan Interest and Deduction), 5498 (Employer's Estimated Tax) or 5498A (Social Security and Railroad Retirement Tax) that is included, treated, or taxed in the year using a calendar year filing requirement, use Form 1065-B.
Who should complete Form 1065-B?
Anyone may complete their 1065-B because it is voluntary for the taxpayer to furnish information related to their federal income. Some taxpayers believe that a 1065-B form is a private record of their private tax information and therefore the IRS requires consent from the taxpayer. This is not true. The 1065-B form that we complete for tax years 2013 through 2017 is an informational form that the taxpayer may complete only with their consent. You do not have to sign a consent form before sending the form off to the IRS. You do not even have to receive a consent form back. We will not ask you to sign a consent form at the time we issue the form. What We Ask of Taxpayers Who Submit a 1065-B for Form 1040 This form is used to report gross income for the current year and all the tax years for which the Form 1040 has been filed for the taxpayer. The taxpayer's tax return will be processed after we have reviewed a completed 1065-B. The Form 1065-B does not contain any information regarding current income. Taxpayers may be required by the IRS to submit a Form 1040 for each tax year during which their income information is missing. For information about these procedures, see our General Information on Form 1040. What if I'm a joint filer with my spouse and I completed Form 1065-B for him and I sent it to his tax preparer? If your 1065-B had a line for Form 1040, you are not a dependent of the taxpayer for this tax year. You are required to complete the joint 1065-B and include that information with your own 1040. However, your 1065-B may include information about the other taxpayer for that tax year. For purposes of determining your eligibility by filing a joint tax return, the other taxpayer will be treated as the taxpayer who reported the lowest adjusted gross income and a lower standard deduction on the Form 1040. This means that all tax years for which he made the most money will be considered a tax year in which he reported the least adjusted gross income. It may also be that you also had an adjusted gross income (AGI) of a certain level. If you are a dependent of a taxpayer, and you submit a 1065-B for him, you don't need to include his information with your own form.
When do I need to complete Form 1065-B?
If you are a resident of Puerto Rico, there are no taxes or penalties for withholding. If you are not a resident of Puerto Rico, you should complete Form 1065-B by March 1, April 30 and July 1 because you'll be required to take the same amount of the withholding and payment for Puerto Rico. If you file Form 1095-A, you must use the same withholding and payment rules to receive the payment for Puerto Rico as would apply for yourself. What does “pending collection of excise taxes due on merchandise” mean? “Pending collection of excise taxes due” refers to the amount of excise taxes you'll owe after you file your return for the year and any additional amounts required by law. Any amounts you pay to a business on tax day are considered accrued and will be charged to business accounts as they accrue. The income tax return and Form 1095-EZ for each business entity is due on or before the anniversary date of the beginning of the calendar year for which the filing will be made. For each year, you must attach a completed Form 1065-B (Form 1065-B-EZ) that shows the following information: Your name and Social Security number; Your full occupation and employer identification number; The gross income from self-employment (as reported on Form W-2); The basis and date of sale of the property; The date of purchase or sale that qualifies the property for the 1065-B deduction; Your gross income for the calendar year.
