Individuals also must include in the gross income of the taxpayer all gifts, bequests, and inheritances if received by the taxpayer within the taxable year. Taxpayers may choose not to take advantage of the exclusion from gross income when reporting the proceeds of disposition of property acquired as capital gains which are treated as qualified property under Section 1245.
