However, individuals receiving exempt payments from the United States or a State and individuals who qualify for an exemption from Federal withholding requirements shall comply with the requirements described in Regulations section 1.5613-4(a) to (m) concerning all individual exempt payments, including withholding required to be reported on Forms W-2, 1099-MISC, and 1099-MISC and including the total amount of benefits and allowances for the calendar year under section 521. Individuals also must include in the gross income of the taxpayer all gifts, bequests, and inheritances if received by the taxpayer within the taxable year. Taxpayers may choose not to take advantage of the exclusion from gross income when reporting the proceeds of disposition of property acquired as capital gains which are treated as qualified property under Section 1245.
